Website Privacy Policy

PROLMAR, LLC (hereinafter referred to as “Company”, “we”, “us”, or “our”) provides a website to offer software services (the “Services”). This Privacy Policy (“Policy”) describes our practices and policies regarding the use and processing of Personal Information while providing the Services. It explains the kinds of Personal Information we collect through prolmar.com and, where applicable, our mobile application, the Prolmar App available on the Google Play Store and Apple App Store (collectively, the “Platform”), how we use that information, our legal basis for doing so, with whom we share it, your rights and choices, and how you can contact us about our privacy practices. This Policy does not apply to third-party sites, products, or services, even if they link to our Services or Platform; you should consider those third parties’ privacy practices carefully.

By acknowledging this Policy, you accept the practices described here (including new versions as they go into effect) and our Terms of Use (the “Terms”), which govern this Policy and contain all disclaimers of warranties and limitations of liability.

Definitions

Capitalized words not defined in this Policy are defined in our Terms. It is important to read this Policy alongside the Terms to understand key concepts.

Business
For the purpose of the CCPA, refers to the Company as the legal entity that collects Consumers’ Personal Information and determines the purposes and means of processing, and that does business in the State of California.
CCPA
The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (“CPRA”) (collectively, “California Privacy Laws”).
Company
Refers to PROLMAR, LLC, a company incorporated and validly operating in Wyoming, with its registered address at 30 N Gould St Ste R, Sheridan, WY 82801. For the purposes of the GDPR, the Company is the Data Controller.
Consumer
For the purpose of the CCPA, means a natural person who is a California resident (as defined by law).
Data Controller
For GDPR purposes, the legal person which determines the purposes and means of processing Personal Data alone or jointly with others.
Data Subject
A natural person who can be identified or made identifiable through personal data.
Device
Any device suitable to access the Service (e.g., computer, cellphone, tablet) with an internet connection.
Do Not Track (DNT)
A concept promoted by U.S. regulatory authorities for an internet mechanism allowing users to control tracking of their online activities across websites.
GDPR
EU Regulation 2016/679 (“EU GDPR”) and the UK GDPR (as retained in UK law), as amended or superseded from time to time.
Personal Information / Personal Data
Any information relating to an identified or identifiable individual. For EU/UK GDPR, includes identifiers such as name, ID number, location data, online identifier, or factors specific to identity. For CCPA, includes information that identifies, relates to, describes, or could reasonably be linked with a consumer or household.
Personal Data Breach
A breach of security resulting in accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Personal Data.
Personal Data Protection Legislation
Applicable personal data protection laws at the time and place of processing, including CCPA and GDPR.
Sale of Data
For CCPA purposes, selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating a Consumer’s Personal Information to another business or third party for monetary or other valuable consideration.
Service Provider
Any natural or legal person who processes data on behalf of the Company (considered a Data Processor under the UK GDPR).
Third Party
Any natural or legal person that is not part of the Company.
Third-Party Services / Third-Party Service Provider
Products, tools, websites, or applications provided by third parties that users can benefit from and that may be integrated to support the Platform.
UK GDPR
United Kingdom General Data Protection Regulation, together with the Data Protection Act 2018.
Usage Data
Data collected automatically, generated by use of the Service or Service infrastructure (e.g., duration of a page visit).
Platform
The website (including subdomains) and mobile application belonging to the Company, accessible via prolmar.com and the app stores.
User / “you”
The individual or legal entity accessing or using the Platform and Services. For GDPR purposes, you can be referred to as the Data Subject.

How We Collect Data

We collect Personal Information from certain sources to provide the Services and manage the Platform, including information you provide and information from third parties. Declining to provide required information may limit your ability to use certain features.

a) Platform Users and the Services

We collect information from and about you and your interactions with us—for example, when you visit our Platform, use the Services, leave comments or feedback, reach out to support, or contact us via any provided channel.

b) Third-Party Integrations (Service Providers)

We engage third-party service providers to perform certain services on our behalf when personal data is necessary for them to perform their duties. They are prohibited from using Personal Information for other purposes and are obligated to comply with applicable laws and requirements. Their own terms and privacy policies apply.

c) Third-Party Analytics and Advertisements

We may use third-party ads, analytics, and tracking tools (e.g., cookies, web beacons, pixel tags, log files, flash cookies) to understand usage and improve Services, content, and advertising. These third parties may combine information collected on our Platform with information from other sources.

a) Personal Data that We Collect from Users

While using our Service, we may ask you to provide Personal Information to enable transactions, manage registrations, contact you, and/or identify you, including (without limitation):

Our Platform uses cookies and similar technologies to function effectively. These record usage information, including:

With your prior permission, we may collect photos, files, and information from your device’s contacts, camera, microphone/voice recordings, photo library, and files to provide features (e.g., scanning, uploading a profile photo). You can enable/disable access in your device settings.

We may also analyze usage via tools such as Google Analytics, and note that Google Play Store and Apple App Store have their own privacy policies.

Use of Personal Data

a) Our Services

We use collected/obtained information to conduct our business and provide products, Services, and online experiences. We rely on several legal grounds (contract, legal obligations, legitimate interests, and, where required, consent), including to:

Legal and regulatory compliance: identity verification; accounting, auditing, and billing; responding to court orders/lawsuits/subpoenas/government requests; and other compliance obligations.

Legitimate interests: mitigate loss/claims/liability; protect security/integrity; respond to inquiries and provide support; improve and develop Services; operate and optimize Platform performance; conduct aggregate analysis and business intelligence; share data with service providers/business partners who help operate and improve our business; ensure network/wallet/information security.

If we need to use your Personal Data in other ways, we will notify you and, if required, obtain consent.

b) Marketing and Events-related Communications

We may send email marketing communications about the Company and Services, invite participation in events/surveys, or otherwise communicate for marketing, in accordance with applicable consent requirements. If we collect business/contact details at trade shows or other events (online or in-person), we may follow up, send requested information, and—with permission—include you in campaigns.

How We Share Personal Data

We may share Personal Data to: (i) satisfy law/regulation/legal process/governmental requests; (ii) enforce this Policy and our Terms (including investigating potential violations); (iii) detect, prevent, or address fraud, security, or technical issues; (iv) respond to your requests; (v) protect rights, property, or safety of the Company, Users, or the public; or (vi) fulfill obligations arising from contracts with Users.

We share Personal Data with a limited number of service providers (e.g., hosting, data analysis, IT and infrastructure, customer service, email delivery, auditing). They may need access to Personal Data to perform their services and are authorized to use/disclose it only as necessary and as required by law, subject to confidentiality/security obligations.

We may disclose aggregate information to third parties (e.g., advertisers, content distributors). Generally, we do not share personal information for third-party marketing/advertising purposes. See the GDPR/CCPA sections for choices about online advertising.

We share Personal Data with business partners and third parties as necessary to provide our Services and maintain user accounts, subject to their privacy policies.

In the event of a transaction altering our business structure (e.g., reorganization, merger, sale, JV, transfer, change of control), we may share Personal Data to facilitate/complete the transaction.

We also share Personal Data as necessary to comply with law/payment method rules, enforce contractual rights, protect rights/privacy/safety, and respond to public authority requests (which may include authorities outside your jurisdiction).

California residents can exercise rights by emailing hello@prolmar.com. We will disclose/deliver required information within 45 days of receiving a verifiable request, extendable once by 45 days when reasonably necessary with prior notice.

Do Not Sell My Personal Information

We do not sell Personal Information. However, certain service providers may use technology on the Service that could be deemed a “sale” under the CCPA. To opt-out of interest-based advertising and such potential “sales,” you may use our in-Service controls:

Opt-out is browser-specific and cookie-based; if you change browsers or delete cookies, you may need to opt-out again. On mobile, you can use device settings (e.g., “Opt out of Interest-Based Ads” on Android; “Limit Ad Tracking” on iOS) and disable location collection in device preferences.

“Do Not Track” (CalOPPA)

Our Service does not respond to DNT signals. Some third-party websites may track browsing; adjust browser settings to indicate your DNT preference.

California Privacy Rights for Minors (B&P §22581)

California residents under 18 who are registered users may request removal of publicly posted content. Contact us with the account email. Removal is not guaranteed where the law does not permit or require it.

Security and Retention

We implement organizational, technical, and administrative measures designed to protect Personal Data against unauthorized access, destruction, loss, alteration, or misuse. Access is limited to personnel who require it to perform their duties. No system is 100% secure; if you believe your account is compromised, contact us immediately.

We retain Personal Data while providing Services and thereafter as necessary to comply with legal/regulatory obligations (e.g., tax, accounting, financial reporting), contractual commitments, and payment method rules, consistent with applicable limitation periods and retention requirements. We also take measures to delete or de-identify data when no longer necessary, considering the type of Services, our relationship, potential re-enrollment, service impacts, mandatory retention periods, and statutes of limitation.

International Data Transfers

We are a global business. Personal Data may be stored and processed in any country where we operate or engage service providers, including countries with different data protection rules. We take measures to ensure transfers comply with applicable laws and that Personal Data remains protected. In certain circumstances, public authorities in those countries may access your data.

Use by Minors

The Services are not directed to individuals under 18 (California residents) and under 16 (United Kingdom citizens). They should not provide Personal Data through the Services. If you believe a minor has provided Personal Information, please contact us.

Updates to This Policy and Notifications

We may update this Policy to reflect new services, changes in data practices, or relevant laws. The “Last Updated” date indicates the latest revision. Changes are effective when posted on the Platform. We may provide disclosures/alerts by posting them on the Platform and, if you are a User, by contacting you via Company email.

The Services may link to other sites that operate independently and have their own privacy notices/policies. If a linked site is not owned/controlled by us, we are not responsible for its content, use, or privacy practices.

Jurisdiction

The Company focuses on multinational compliance regulations, including UK GDPR, EU GDPR, and U.S. Privacy Laws, to make privacy a priority. You may request further information on our processing activities based on your country’s laws.
